OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by or crushing hazards. Instance a. Bay 3 - On or about April 5, 2019, employees were exposed to crushing and struck by hazards while working in close proximately or underneath the Nussbaum two post auto lift which had damaged support cables and this lift unexpectedly dropped 3 inches while employees were working underneath it. Instance b. Bay 5 - On or about April 5, 2019, employees were exposed to crushing and struck by hazards while working in close proximately or underneath the Nussbaum two post auto lift where the safety locks were not engaging when in use. Instance c. Bay 7 - On or about April 5, 2019, employees were exposed to crushing and struck by hazards while working in close proximately or underneath the Nussbaum two post auto lift where the safety locks were not engaging when in use. Instance d. Bay 8 - On or about April 5, 2019, employees were exposed to crushing and struck by hazards while working in close proximately or underneath the Nussbaum two post auto lift where the air system was leaking down when in use.

Second-floor level - On or about April 2, 2019, the second story exterior emergency exit was not adequately maintained in that the employees would be required to travel through a passageway which was overgrown by vegetation preventing the use of the escape ladder in case of an emergency event.
