Construction, LLC at 908 South Paulton Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 3, 2019, the controlling employer did not ensure that an employee working on the roof of a single family home was protected from fall hazards. An employee working on a roof engaged in gutter installation activities was not protected from fall hazards. This condition exposed the employee to a fall hazard between 8 feet and 16 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)L.A.W. Construction, LLC at 908 South Paulton Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 3, 2019, the employer did not ensure that each employee engaged in gutter installation activities on the roof of a single-family home had been trained to recognize the hazards associated with working at elevations over 6 feet. Employees had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 8 feet to 16 feet.

Construction, LLC at 908 South Paulton Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 3, 2019, the controlling employer did not ensure the side rails of an extension ladder were extended at least three feet above the roof. Employees utilized the extension ladder to access the roof of a single-family home to install gutters. This condition exposed employees to a fall hazard of approximately 8 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: (a)L.A.W. Construction, LLC at 908 South Paulton Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 3, 2019, the employer did not provide a training program for each employee using extension and A-frame ladders to train each employee in the procedures to be followed to minimize hazards related to ladders. This condition exposed the employees to a fall hazard of up to approximately 6 and 8 feet. Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c) The proper construction, use, placement, and care in handling of all stairways and ladders; (d) The maximum intended load-carrying capacities of ladders; and (e) The standards contained in this subpart.
