29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices. On or about March 26, 2019, the employer failed to document that equipment complied with recognized and generally good engineering practices (RAGAGEP) for the following: b. An emergency shower and eyewash external to the engine room was not readily accessible for emergency use during an ammonia release. The employer failed to document compliance with RAGAGEP such as IIAR 2-2008 - Equipment, Design, and Installation of Closed-Circuit Ammonia Mechanical Refrigerating Systems, Section 13.1.6.1 (2012), when employees that worked in the ammonia machine room were potentially exposed to ammonia vapors/burns and had no emergency eyewash or shower immediately available on the exterior of the machine room. There is no abatement certification or documentation required for this item.

29 CFR 1910.119(f)(1)(iii)(B): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information that addressed health and safety considerations, such as precautions necessary to prevent exposure, including engineering controls, administrative controls, and personal protective equipment. On or about March 26, 2019, the employer did not ensure the written Standard Operating Procedures (SOP) for oil pot draining included the requirements of wearing the following personal protective equipment such as, but not limited to, eye, face, hand and the respiratory protection needed to protect against exposures to anhydrous ammonia. There is no abatement certification or documentation required for this item.

29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means were taken to assure safe operation: b. On or about March 26, 2019, piping on the HSD, EQ and relief valve along with Evaporators 1-25 valve stations located near the condenser and/or the roof top were in need of repairs such as scraping and/or painting to prevent access of water or water vapor which could potentially cause corrosion within internal piping. The employer did not correct deficiencies in equipment accordance with the recognized and generally good engineering practices (RAGAGEP) such as, but not limited to, IIAR Bulletin 109 (1997) - Guidelines for: IIAR Minimum Safety Criteria for a Safe Ammonia Refrigeration System, Section 4.7.4 and IIAR Bulletin 110 (1993) - Guidelines for: Start-up, Inspection and Maintenance of Ammonia Mechanical Refrigerating Systems, Section 6.7.1. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
