29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a) J & C Concrete located at 6996 E Archer Place, Denver, CO 80230:  On and before April 3, 2019, the employer did not ensure that an inspection of the excavation, the adjacent areas, and protective systems was conducted by the competent person prior to the start of work and as needed throughout the shift.  Employees were working in a basement excavation next to the face of the unprotected sections preparing to install forms prior to pouring concrete.  The unprotected sides of the excavation were over 7 feet and the workers were within 1 foot of the face.  The employer did not plan and carry out the work in a manner that would limit the time the employees were working near the excavation.  The employer did not perform inspections of the excavation or adjacent areas prior to starting work or at any point after employees entered.  The following condition exposed employees to caught-in and struck-by hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) J & C Concrete located at 6996 E Archer Place, Denver, CO 80230:  On and before April 3, 2019, the employer did not develop, implement, and/or maintain at the workplace a written hazard communication program.  Employees were installing forms using form oil and pouring concrete on the foundation of a new construction residential home.  A program was not developed to inform each employee of the potential hazards of the chemicals that they are exposed to which primarily consists of Specstrip reactive form release agent and concrete.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  (a) J & C Concrete located at 6996 E Archer Place, Denver, CO 80230:  On and before April 3, 2019, the employer did not maintain and provide, in the workplace, copies of the required safety data sheets for each hazardous chemical employees were exposed to. Employees were installing forms using form oil and pouring concrete on the foundation of a new construction residential home.  SDS's were not available to inform each employee of the potential hazards of the chemicals that they are exposed to which primarily consists of Specstrip reactive form release agent and concrete.
