29 CFR 1926.20(b): Accident prevention resposibilities.  29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a. For the worksite located at 1694 Tuscarora Drive, Grove City, Ohio: On or about April 3, 2019, the employer failed to perform inspections of the job site as part of an accident prevention program to address hazards associated with rough framing construction of residential housing. Due to the lack of accident prevention program job site inspection, employees were exposed to hazards associated with the lack of fall protection for elevated work and the lack of eye protection when working with cutting and fastening tools.

For the worksite located at 1694 Tuscarora Drive, Grove City, Ohio: On or about April 3, 2019, the employer failed to perform training or instruct employees in the recognition of unsafe conditions/hazards, in the avoidance of unsafe conditions/hazards and the OSHA regulations applicable to rough framing in residential single family home construction.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. For the worksite located at 1694 Tuscarora Drive, Grove City, Ohio: On or about April 3, 2019, the employer failed to provide a fall protection training program for employees who performed elevated work greater than 6 feet during framing work. Employees performed work without fall protection from heights of up to 20 feet.

29 CFR 1926.102(a)(2): The employer shall ensure that each affected employee uses eye protection that provides side protection when there is a hazard from flying objects. Detachable side protectors (e.g. clip-on or slide-on side shields) meeting the pertinent requirements of this section are acceptable.   a. For the worksite located at 1694 Tuscarora Drive, Grove City, Ohio: On or about April 3, 2019, the employer failed to ensure that employees used eye protection when performing framing work. Framers did not wear eye protection and were exposed to a hazard from flying objects during pneumatic nailing of sheathing and during circular saw use.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. For the worksite located at 1694 Tuscarora Drive, Grove City, Ohio: On or about April 3, 2019, the employer failed to require fall protection use during framing work performed during framing work performed during the construction of a single family home. Employees worked installing sheathing and framing components without fall protection at heights of up to approximately 20 feet.
