29 CFR 1910.23(c)(11): (11) Portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface (see Figure D-1); a. On or about April 3, 2019, located at 7001 Sunbury Road in Westerville, Ohio, employees climbed on to an extension ladder that did not extend at least three feet above the landing surface, thereby exposing the employees to a maximum fall hazard of approximately eight feet.

29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: 1910.28(b)(1)(i)(A) Guardrail system; 1910.28(b)(1)(i)(B) Safety net system; or 1910.28(b)(1)(i)(C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a. On or about April 3, 2019, located at 7001 Sunbury Road in Westerville, Ohio, employees were working on a steep-pitched roof (Approximately 6/12 pitch) in order to caulk around a roof window trim without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 11 feet. b. On or about April 3, 2019, located at 7001 Sunbury Road in Westerville, Ohio, employees walked across an outdoor refrigeration unit to access a ladder without any means of fall protection, thereby exposing the employees to a fall hazard of approximately eight feet.
