29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) This violation occurred on or about April 2, 2019 and at time prior thereto, when the employer did not instruct employees working inside an excavation in the recognition, avoidance, elimination and control of unsafe conditions associated with cave-ins when working outside the trench box and the displacement/sliding of soil, rocks and other materials from the face of the excavation.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) On or about April 2, 2019 and times prior, employees working inside an excavation were exposed to a struck-by hazard from loose soil, rocks, and other objects such as broken PVC pipes on the face of a trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) On or about April 2, 2019 and times prior, the employer did not ensure employees working inside an excavation and stepping outside the trench box to perform activities such as lubricating the PVC pipes were protected from a cave-in hazard.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart:  (a) On or about April 2, 2019 and times prior, the employer did not ensure that the vertical height between the lower part of the slope and the top portion of the trench box was at least 18 inches as required in appendix B of 1926 subpart P for cohesive soil type B.
