29 CFR 1910.147(c)(6): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed: The periodic inspection must: a) Be performed by an authorized employee other than the ones utilizing the energy control procedure being inspected, b) Be conducted to correct any deviations or inadequacies identified, c) Where lockout is used for energy control, include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected, d) Where tag-out is used for energy control, include a review between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section: On or about 3/26/19, the employer failed to ensure that the lockout/tagout procedures were audited at least annually on machinery including, but not limited to the Drag Conveyor DC01, Drag Conveyor DC02, Beaumer Elevator Motor, Mill motor service crane, C-2 Belt Conveyor, and the Mill #1 Air Slide Blower.

(formally known as Essroc Cement Corporation) was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(c)(4)(i) which was contained in OSHA inspection number 1105040 citation number 1, item number 3a, and was affirmed as a final order on 7/29/2016, with respect to a workplace located at 8282 Middlebranch Road, Middlebranch, Ohio 44652.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about 3/26/19, the employer failed to ensure that lockout/tagout procedures were followed while performing maintenance activities on machinery, including, but not limited to the Silo #4 Knife Gates. The following was not completed in sequence: 1) Prepare for shutdown, 2) Machine shutdown, 3) Machine isolation, 4) Lockout device application, 5) Release stored energy, and 6) Verification of isolation. Types of energy include pneumatics, electrical, and gravity. Lehhigh Cement, LLC. (formally known as Essroc Cement Corporation) was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(d)(4)(ii) which was contained in OSHA inspection number 1105040 citation number 1, item number 3b, and was affirmed as a final order on 7/29/2016, with respect to a workplace located at 8282 Middlebranch Road, Middlebranch, Ohio 44652.
