29 CFR 1910.22(b): The employer did not ensure that each walking-working surface could support the maximum intended load for that surface:    (a) LifeScape at 2501 West 26th Street, Sioux Falls, SD 57105: On or about and at times prior to April 3, 3019 the employer did not ensure the window well cover on the north side of the main entrance could support an employee accessing an electrical outlet over the grating. An employee suffered a fall of approximately 7.5 feet when exposed to this hazards that resulted in fractured vertebra and ribs. This condition exposed employees to fall hazards.

29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces were inspected regularly and as necessary, and maintained in a safe condition;  (a) LifeScape at 2501 West 26th Street, Sioux Falls, SD 57105: On or about and at times prior to April 3, 3019 the employer did not inspect the window well cover on the north side of the main entrance to ensure that it was maintained in a safe condition. An employee suffered a fall of approximately 7.5 feet when exposed to this hazard resulting in fractured vertebra and ribs. This condition exposed employees to fall hazards.

29 CFR 1904.29(b)(1): The log of occupational injuries and illnesses, (OSHA Form No. 300), was not completed in the detail provided in the form and instructions contained therein:    LifeScape at 2501 West 26th Street, Sioux Falls, SD 57105: On or about and at times prior to April 3, 3019 the employer did not ensure the log of occupational injuries and illnesses (OSHA Form No. 300) was completed in the following cases, among others:    (a)Case No. R222029 on or about February 21, 2019 an employee was kicked and struck by a knee in the head that resulted in a concussion. Section (K) states the employees was away from work for 5 days, however section (L) does not note work restrictions put on employee.     (b)Case No. R222566 on or about March 4, 2019 a person supported fell on an employee resulting in a knee injury. Section (F) does not specify the parts of the body affected and the object/substance that directly injured or made the person ill.  This injury resulted in time away from work and/or restrictive transfer or job restrictions. Sections (k) and/or (L) do not record any entries.     (c)Case No. R226119 on or about April 2,2019 an employee suffered a knee injury when participating in PCM training. This injury is listed as a sprained knee in section (F), however the injury was a torn meniscus of the left knee. This injury result time away from work and/or restrictive transfer or job restrictions. Sections (k) and/or (L) do not record any entries.    (d) Case No. R226002 on or about April 3, 2019 an employee fell through a window well grate and suffered fractured vertebra and ribs. This incident occurred on the exterior of the building over a window well near the North side of the main entrance of the facility. Section (E) stated the event occurred at LifeScape School Dorm.

29 CFR 1904.29(b)(2): The employer did not fill out or correctly fill out an OSHA Form 301 or equivalent for each recordable  injury or illness:   LifeScape at 2501 West 26th Street, Sioux Falls, SD 57105: On or about and at times prior to April 3, 3019 the employer did not ensure the OSHA Form 301 was filled out correctly and completed in the following cases, among others;  (a) Case No. R222029 on or about February 21, 2019 an employee was kicked and struck with a knee in the head that resulted in a concussion. First report of injury from claim 101353 states the employee received onsite treatment. Another first report of injury for the same incident, claim 222029 on form DOL-LM-101, stated the employee received treatment at the Sanford Hospital emergency room.  (b) Case No. R222566 on or about March 4, 2019 a person supported fell on an employee resulting in a knee injury. The doctor, clinic or hospital name and associated contact information is not filled out on the first report of injury form.  (c) Case No. R226002 on or about April 3, 2019 an employee fell through a window well grate and suffered fractured vertebra and ribs. The doctor, clinic or hospital name and associated contact information is not filled out on the first report of injury form. The injury or illness  and the source of the injury is not specified.
