29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Warehouse - An employee who was loading the shredder and operating a forklift was exposed over the action level of 85 dBA or 66 percent. The employee was exposed to noise levels at 126.4 % of the allowable 8-hour time weighted average (TWA) sound level (85 dBA) or an equivalent sound level of approximately 91.7 dBA during the 377 minute monitoring period, on or about May 9, 2019.
