29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about 4/1/19 at a roof project located at 5662 Wendy Circlet, Lockport, New York; employees working on the ground below active roof operations were not wearing hard hats.  NO ABATEMENT CERTIFICATION REQUIRED  DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1234454, citation number 1, item number 1 and was affirmed as a final order on 10/11/17, with respect to a workplace located at 33 Sterling Place, Lancaster, New York.  DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1238976, citation number 1, item number 1 and was affirmed as a final order on 10/11/17, with respect to a workplace located at 2 Kelly Anne Drive, Lancaster, New York.  DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1260265, citation number 1, item number 1 and was affirmed as a final order on 10/11/17, with respect to a workplace located at 474 Delaware Road, Kenmore, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 4/1/19 at a roof project located at 5662 Wendy Circle, Lockport, New York; employees were placing shingles on the roof of a two story house. The roof had a 5 in 12 pitch and an eave height of approximately 18 feet. There was no fall protection in use.  NO ABATEMENT CERTIFICATION REQUIRED  DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1234454, citation number 1, item number 3 and was affirmed as a final order on 10/11/17, with respect to a workplace located at 33 Sterling Place, Lancaster, New York. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 4/1/19 at a roof project located at 5662 Wendy Circle, Lockport, New York; employees were installing shingles on the roof of a two story house. Employees were accessing the roof with an extension ladder and the side rails of the ladder did not extend 3 feet above the landing surface.  NO ABATEMENT CERTIFICATION REQUIRED  DM Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1234454, citation number 1, item number 4 and was affirmed as a final order on 10/11/17, with respect to a workplace located at 33 Sterling Place, Lancaster, New York.
