29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 12/4/18 at a roof project located at 33 Reservation Street, Buffalo, New York; employees were removing shingles from the roof of a two story house. The roof had a 8 in 12 pitch and an eave height of approximately 14 feet. There was no fall protection in use.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 4/2/19 at a roof project located at 175 Tremaine Avenue, Kenmore, New York; employees were removing shingles from the roof of a two story house. Employees were accessing the roof with an extension ladder and the side rails of the ladder did not extend 3 feet above the landing surface.  NO ABATEMENT CERTIFICATION REQUIRED
