29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 4/2/19, inside a Home 2 Hotel under construction at 3820 Ridge Lea Rd., Amherst NY: Two employees were exposed to falls of approx. 27 to 37 ft. to the ground through wall openings in rooms on the 3rd & 4th floors on the east side of the building near the south end because no fall protection system was being utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.30(a)(1): Before any employee is exposed to a fall hazard, the employer did not provide training for each employee(s) who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017: a) On or about 4/2/19, inside a Home 2 Hotel under construction at 3820 Ridge Lea Rd., Amherst NY: Two employees who were exposed to falls of approx. 27 to 37 ft. to the ground through wall openings were not trained about the nature of fall hazards in the work area; how to recognize the fall hazards; the procedures to be followed to minimize those hazards; and the procedures for installation, maintenance & use of fall protection systems used, such as but not limited to personal fall arrest systems. ABATEMENT CERTIFICATION REQUIRED
