OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a.) On or about, April 4, 2019, and at times prior thereto, employees were potentially exposed to burn and fire hazards in that the employer did not complete a written safety process pertaining to the connection of  multiple components of display firework devices consisting of Hazard Class/Division  1.4G explosives to a display board.  ABATEMENT NOTE:  Among other methods, one feasible and acceptable means of abatement is to compile information that complies with recognized and generally accepted good engineering practices (RAGAGEP) such as, but not limited to, NFPA - 77, 495, 1123, 1124, 1126, and ATF Regulations.    b.) On or about, April 4, 2019, and at times prior thereto, employees were potentially exposed to burn and fire hazards in that the employer did not perform an initial  hazard evaluation pertaining to the process of connecting multiple components of display firework devices consisting of Hazard Class/Division 1.4G explosives to a display board.  ABATEMENT NOTE:  Among other methods, one feasible and acceptable means of abatement is to conduct a process hazard analysis using a methodology including, but not limited to, What If, Checklist, What If/Checklist, Hazard and Operability Study, Failure Mode and Effects Analysis, or Fault Tree Analysis.    c.) On or about, April 4, 2019, and at times prior thereto, employees were potentially exposed to burn and fire hazards in that employer did not develop and implement written operating procedures that provided clear instructions for safely conducting operations including, but not limited to, the connection of display firework devices consisting of Hazard Class/Division 1.4G explosives to a display board.  ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement is to develop and implement written operating procedures that provide clear instructions for safely connecting display firework devices consisting of Hazard Class/Division 1.4G explosives to a display board.  Additionally, the written operating procedures shall also address the limitation of electronic devices that are permitted in the assembly area during work operations.

Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

Employees have the potential to be injured without having immediate first aid treatment due to the location of the nearest hospital or clinic.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
