29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): (Construction Reference: 1926.59) On or about April 5, 2019, at 1300 West Avenue, Miami Beach, FL 33140, the employer allowed employees to be exposed to injury and/or illness during concrete pouring and finishing activities, in that none of the contractors involved share their Hazard Communications program nor addressed in their respective Hazard Communications programs how contract employees would be informed of the hazards of chemicals in the workplace. Hazardous materials at the jobsite include, but are not limited to, Portland Cement (a corrosive, with a pH of 12-13).

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. On or about April 5, 2019, at 1300 West Avenue, Miami Beach, FL 33140, the employer did not provide and/or enforced the use of eye and/or hand protective equipment for employees performing concrete pouring operations, and who were required to work with hazardous chemicals, including, but not limited to, Portland Cement (a corrosive, with a pH of 12-13).
