29 CFR 1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On or about April 4, 2019 at 746 Element Way in Ashwaubenon, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazard(s) associated with employees walking/working on a patio with unprotected edges forty-five feet above surface level, jumping down fifty-two inches to surface level from a scaffold platform, climbing on scaffold end frames without using ladder rungs to access scaffold platforms, and working on scaffold platforms greater than ten feet above surface level without complete guardrails system installed.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used.  On April 4, 2019 at 746 Element Way in Ashwaubenon, an employee was jumping off a scaffold platform down fifty-two inches to surface level to exit the platform.

29 CFR 1926.451(e)(6)(i):  Integral prefabricated scaffold access frames shall be specifically designed and constructed for use as ladder rungs.  On or about April 4, 2019 at 746 Element Way in Ashwaubenon, employees were climbing on a scaffold end frame without using the built-in rungs to access/egress between a bracket platform fifty-two inches above surface level and an upper scaffold platform approximately seventy inches above surface level.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  On April 4, 2019 at 746 Element Way in Ashwaubenon, an employee was working from a bracket scaffold platform at greater than forty feet above surface level without a complete guardrail system installed at one end of the platform.

29 CFR 1926.454(a)(1):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards including the nature of any electrical hazards, fall hazards and falling object hazards in the work area.    On April 4, 2019 at 746 Element Way in Ashwaubenon, the employer did not provide required scaffold safety training for employees who did not associate fall from elevation hazards when working from scaffold without a complete guardrail system, climbing end frames without using rungs to access/egress platforms, and jumping off a platform greater than two feet above surface level.

On April 4, 2019 at 746 Element Way in Ashwaubenon, the employer did not provide required scaffold assembly/disassembly safety training for employees who did not associate fall from elevation hazards from equipment set-up without a complete guardrail system on a bracket scaffold and end frames used to access/egress platforms without the built-in ladder rungs accessible to employees.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a)  On or about April 4, 2019 at 746 Element Way in Ashwaubenon, employees were using a patio with unprotected edges as an access/egress path to the work area forty-five feet above surface level without utilizing required fall protection equipment.    b)  On or about April 4, 2019 at 746 Element Way in Ashwaubenon, an employee was working at the edge of a patio removing/placing materials and/or equipment on the fork of a rough terrain forklift at forty-five feet above surface level without utilizing required fall protection equipment.
