29 CFR 1926.100(b): Helmets for the protection of employees against impact and penetration of falling and flying objects did not meet the specifications contained in American National Standards Institute Z89.1-1969, Safety Requirements for Industrial Head:  On or about April 5, 2019, the employer failed to ensure employees working at ground level on a job site, where gutters were being removed and replaced,  had head protection on to protect them from old gutters and debris being thrown, knocked or dropped off of a roof above them.

On or about April 5, 2019, the employer failed to ensure employees working on removing gutters and installing new ones wore protective eyewear to protect them from flying debris and particles when they were using electric power tools such as but not limited to hand held drills.

The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated:  Ladders shall be used only for the purpose for which they were designed.  On or about April 5, 2019, the employer failed to ensure employees were using the ladders provided at the job site as they were intended to be used.  An employee was observed, to include but not limited to, standing on the 2nd rung from the top of a 15 foot ladder and while holding on, was trying to "hop" the ladder over on the roof to access another section of the roof.

The employee was removing the old gutters of a home and replacing them with new.  There was no fall protection or arrest system in place at the time.  NOTE:  The employer was previously cited for a violation of this occupational safety and health standard or it's equivalent standard which was contained in OSHA Inspection #1055759, citation 1, item 1b, which was affirmed as final order on June 6, 2015, with respect to the workplace located at 1816 35th Street, Lorain OH.

Employees were working at heights of approximately 10.6 feet at a residential job site in order to remove the old gutters of a home and replacing them with new.  There was no fall protection or arrest system in place at the time.
