OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a) North Wall Column Line: On or about April 2, 2019, the employer allowed employees to be exposed to struck-by hazards in that a heavy duty spreader bar beam was not properly attached to a forklift (JLG Telehandler Forklift Model 644E-42 Serial Number 0160022975) while transporting rebar.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) North Wall Column Line: On or about April 2, 2019, the employer allowed employees to be exposed to struck-by hazards in that a heavy duty spreader bar beam was not properly attached to a forklift (JLG Telehandler Forklift Model 644E-42 Serial Number 0160022975) while transporting rebar. The employer failed to instruct employees in the proper setup for the spreader bar prior to loading the rebar.
