29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) The employer did not ensure employees were using head protection when working under equipment, material, and personnel. At the worksite located at 10551 120th Ave., Pleasant Prairie, WI, an employee was working under the boom of an aerial lift, thereby being exposed to struck-by hazards.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  (a) The employer did not ensure employees were using fall protection when conducting work from an aerial lift. At the worksite located at 10551 120th Ave., Pleasant Prairie, WI, an employee did not fully utilize fall protection systems in an aerial lift, thereby being exposed to a fall hazard.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) The employer did not ensure employees were trained in recognizing fall hazards and implementing fall protection when conducting work from an platform of an aerial lift. On or about 4-9-19, a foreman employee was performing work from an elevated platform located in the drive thru area of a McDonald's restaurant and was not using fall protection.
