29 CFR 1910.106(e)(9)(iii): Combustible waste material and residues in a building or unit operating area were not kept to a minimum, stored in covered metal receptacles and disposed of daily: (a) Permian Tank & Manufacturing, Inc. at 1125 Bonanza Street, Belle Fourche, SD 57717: On or about and at times prior to April 9, 2019, the employer did not ensure employees were protected from fire and chemical hazards in that waste combustible hazardous chemicals were stored in uncovered metal containers in both Blast One Series 5000 Spray Ovens. This condition exposed employees to fire and chemical hazards. Or, In the Alternative 29 CFR 1910.106(h)(8)(iii): Combustible waste material and residues in a building or operating area were not kept to a minimum and/or disposed of daily. The written program shall be available for inspection by employees and their authorized representatives: (a) Permian Tank & Manufacturing, Inc. at 1125 Bonanza Street, Belle Fourche, SD 57717: On or about and at times prior to April 9, 2019, the employer did not ensure employees were protected from hazards associated with welding, grinding, and spraying inside closed tanks in that the company has not developed and implemented a written permit required confined space program. This condition exposed employees to hazards associated with performing work in a permit required confined space.
