On or about April 11, 2019, located at 231 Mannasch Drive (Lot 136 EL) in Granville, Ohio, the employer did not initiate and maintain safety and health programs for employees working at heights, operating pneumatic nail guns, and climbing ladders when framing a house, thereby exposing the employees to fall and struck-by hazards when performing residential construction activities.

On or about April 11, 2019, located at 231 Mannasch Drive (Lot 136 EL) in Granville, Ohio, the employer did not instruct employees in the recognition and avoidance of unsafe condition and the regulation that apply for employees working at heights, operating pneumatic nail guns, and climbing ladders when framing a house, thereby exposing the employees to fall and struck-by hazards when performing residential construction activities.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about April 11, 2019, located at 231 Mannasch Drive (Lot 136 EL) in Granville, Ohio, employees were walking on the top plates of a residential home without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 11 feet. b. On or about April 11, 2019, located at 231 Mannasch Drive (Lot 136 EL) in Granville, Ohio, there was a floor hole on the 1st floor deck with approximately three foot by three foot of the floor hole without guardrails, thereby exposing the employee to a fall hazard of approximately nine feet.
