OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.   a) 626 Boyds Corner Road Middletown, DE - On or about April 11, 2019, employees engaged in directional drilling activities were exposed to hazards created by a rotating drill pipe on an American Augers directional drill, Model DD-6.  While attempting to adjust the alignment of the rotating drill pipe, suspended in a nylon sling, an employee became entangled and sustained an amputation of the right arm and three middle fingers of the left hand.  Among other methods, one feasible and acceptable method of abatement to correct this hazard is to ensure that all workers maintain a safe distance of twenty-five (25) feet from the machine while in operation as outlined throughout the American Augers, Inc. Operation & Safety Instruction Manual, including but not limited to Section 4.3, Dangerous Zones - Safe Distances.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a) 626 Boyds Corner Road Middletown, DE - On or about April 11, 2019, the employer failed to instruct employees in the recognition of hazards and avoidance of unsafe conditions related to their construction related activities. Employees were exposed to hazards related to the use of heavy equipment during horizontal directional drilling activities.  An employee who was assisting in drilling activities and who had not received training related to the hazards of horizontal directional drilling, sustained an amputation of the right arm and three fingers on the left hand.
