29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 03/27/19, at the McDonalds restaurant, under construction and renovation, located on 2341 West Ridge Road, in Greece, New York, the employer did not issue or enforce the use of fall protection while employees were working on an elevated surface (roof top) 12 feet 6 inches above a lower level. NO ABATEMENT CERTIFICATION REQUIRED
