(b) The employer failed to certify that Citation 1, Item 2, issued on 06/14/2018 with an abatement date of 07/11/2019 had been abated.    (c) The employer failed to certify that Citation 1, Item 3, issued on 06/14/2018 with an abatement date of 07/11/2019 had been abated. 29 CFR 1910.178(l)(1)(ii): This provision is applicable to construction per 29 CFR 1926.602(d). The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck  The employer is failing to ensure that all employees are not exposed to struck by or caught between hazards.  This most recently occurred on April 15, 2019 on the jobsite located at 7720 N 159th Avenue in Bennington, Nebraska.  The employer failed to ensure that the employees received the training required prior to operating a powered industrial truck.  In this case, an all-terrain forklift (telehandler) was being utilized to move materials.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles.  The employer is failing to ensure that the eyes and faces of employees are protected from flying particles while working on a residential roof. This most recently occurred on April 15, 2019 on the jobsite located at 7720 N 159th Avenue in Bennington, Nebraska. One employees were observed using hand-held pneumatic nail gun to secure rafters without any form of eye or face protection.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  The employer is failing to ensure that all employees exposed to fall hazards while working at heights of elevation are utilizing fall protection. This most recently occurred on April 15, 2019 on the jobsite located at 7720 N 159th Avenue in Bennington, Nebraska. Two employees were framing a two-story residential building. One employee was observed working on the outer wall of the two-story residential building. Another employee was working in the rafters of a two-story residential building. None of the employees were using any form of fall protection.

29 CFR 1926.1053(a)(8): A metal spreader or locking device was not provided/used on each stepladder to hold the front and back sections in an open position when the ladder was being used:   The employer is failing to ensure employees are not exposed to fall hazards associated with ladder use.  This most recently occurred on April 15, 2019 on the jobsite located at 7720 N 159th Avenue in Bennington, Nebraska. A 10 foot-self supporting ladder did not have the metal spreader or locking device engaged. The ladder was leaned against the wall so that employees could access the upper surface.
