29 CFR 1915.71(k)(1): Access from below to staging more than 5 feet above a floor, deck or the ground did not consist of well secured stairways, cleated ramps, fixed or portable ladders meeting the requirements of Section 1915.72 or of rigid type non-collapsible trestles with parallel and level rungs. a) USS Kennedy CVN-79, North Yard: On or about 03/26/2019, employees required to access staging to wrap pipes were not provided with a safe access in that an 8-ft A-frame ladder was used as a result exposed employees to an 8-ft fall hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.77(c): When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of Subpart E-Scaffolds, Ladders, and Other Working Surfaces, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: a) USS Kennedy CVN-79, North Yard: On or about 03/26/2019, employees working from unguarded staging 8ft from the deck were not provided with a personal fall arrest system. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
