29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: On or about 10/31/2019, the employer failed to certify to OSHA that the following hazards have been abated: (a) Citation 1, Item 1 - On or about April 17, 2019 and at times prior thereto, employees were performing commercial roofing construction at heights of greater than 6 feet above the ground below without fall protection. This condition exposed employees to the hazard of falling to the ground below. (b) Citation 2, Item 1 - On or about April 17, 2019 and at times prior thereto, building material was located at the bottom of the ladder. This condition exposed employees to trip hazards.

On or about 10/31/2019, the employer failed to certify to OSHA that the following hazards have been abated: (a) Citation 1, Item 1 - On or about April 17, 2019 and at times prior thereto, employees were performing commercial roofing construction at heights of greater than 6 feet above the ground below without fall protection. 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. On or about April 17, 2019 and at times prior thereto, employees were performing commercial roofing construction at heights of greater than 6 feet above the ground below without fall protection. This condition exposed employees to the hazard of falling to the ground below. Franklin & Son, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1066033, citation number 1, item number 1 and was affirmed as a final order on July 23, 2015, with respect to a workplace located at 1409 N Salem Road, Fayetteville, Arkansas.
