29 CFR 1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On April 17, 2019 at 330 McClellan Street in Wausau, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with employees walking/working on scaffold platforms without utilizing required fall protection system and without installing required cross-bracing components.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)  On April 17, 2019 at 330 McClellan Street in Wausau, employees were using a scaffold platform sixteen and one half feet above surface level without a completed guardrail system installed; east side scaffold tower.  b)  On April 17, 2019 at 330 McClellan Street in Wausau, employees were using a scaffold platforms ten and one half feet and sixteen and one half feet above surface level without complete guardrail systems installed; south side scaffold tower.  c)  On April 17, 2019 at 330 McClellan Street in Wausau, employees were using a scaffold platform ten and one half feet above surface level without a complete guardrail system installed; south side scaffold tower.

29 CFR 1926.452(c)(2): "Fabricated frame scaffolds" (tubular welded frame scaffolds); Frames and panels shall be braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally. The cross braces shall be of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections shall be secured.  On April 17, 2019 at 330 McClellan Street in Wausau, employees were using a three level scaffold tower along a south central exterior wall without a cross brace installed on one side of the second level work platform ten and one half feet above surface level.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about April 17, 2019 at 330 McClellan Street in Wausau, employees were walking/working on a low slope surface with unprotected edges eighteen feet above surface level without utilizing fall protection equipment.

On April 17, 2019 at 330 McClellan Street in Wausau, employees were working on a steep roof surface twenty feet above surface level without utilizing adequate fall protection equipment.

29 CFR 1926.454(a)(2):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards including the correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used.    On April 17, 2019 at 330 McClellan Street in Wausau, the employer did not provide required scaffold use safety training for employees who did not recognize potential fall hazards associated with working from scaffold platforms without complete fall protection systems installed.

29 CFR 1926.454(b)(2):  The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question; the training shall include the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question.    On April 17, 2019 at 330 McClellan Street in Wausau, the employer did not provide required scaffold assembly/disassembly safety training for employees who did not associate potential fall from elevation hazards when erecting scaffold equipment without installing all required cross bracing components and complete fall protection systems and without securing cross bracing used as mid-rail fall protection equipment.
