29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as necessary to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On or about March 28, 2019 at 2322 Jackson Street in Oshkosh, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards associated with employees working from a roof surface without utilizing fall protection systems and potential fall from elevation hazard associated with damaged fall protection equipment available for use.

29 CFR 1926.502(d)(19): Personal fall arrest systems and components subjected to impact loading shall be immediately removed from service and shall not be used again for employee protection until inspected and determined by a competent person to be undamaged and suitable for reuse.  On or about March 28, 2019 at 2322 Jackson Street in Oshkosh, the employer had damaged personal fall arrest components available for use for employees working on a roof surface at eighteen feet above surface level; two impacted lanyard fall arrestors were loosely folded and wrapped with black tape.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about March 28, 2019 at 2322 Jackson Street in Oshkosh, employees were working from a roof surface installing metal on the roof cornice at eighteen feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii):  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    On or about March 28, 2019 at 2322 Jackson Street in Oshkosh, the employer did not provide required fall protection safety training for employees who did not associate a fall from elevation hazard when working on a roof surface eighteen feet above surface level without required fall protection equipment.
