OSH Act of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust fire hazards presented by an indoor enclosureless dust collector collecting combustible wood dust:  (a)    Woodlogic Custom Millwork, Inc.:  Between April 19, 2019 and October 2, 2019, the employer operated a Dantherm Filtration model NFP-3H OPEN enclosureless dust collector (S/N 314373) in the Production Department to collect combustible wood particulates from several piece of upstream woodworking equipment such as a wide belt sander, shapers, and edge sander, a chop saw, a radial arm saw, a router, table saws, a vertical panel saw, an edge band saw, and a horizontal panel saw.  The specific use and location of this enclosureless dust collector exposed employees to fire hazards associated with the exposure to flames, smoke, and combustion gases in the event of an internal dust collector fire.  The enclosureless dust collector serviced equipment, generally recognized as having a history of producing frequent sparks (wide belt sander), and was located within 20 feet of an exit door, exit route, and operator workstation.   Among other methods, one feasible and acceptable means of abatement is to following the guidance in the National Fire Protection Associations (NFPA) Standard 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, 2017 edition  Sections 8.2.2.6.1.6 (dust collector location and prohibited uses of enclosureless dust collectors) and 8.2.2.3.2 (protection of ducts and downstream collectors where a fire hazard is present).  Specifically:  Ensure that an indoor enclosureless dust collector is not used when (1) any equipment having a history of producing frequent sparks [i.e. large belt sanders and planers having automatic feed systems] is included in the upstream collection stream or (2) the collector is located within 20 feet of any means of egress or area routinely occupied by personnel.  Alternative technologies include the use of an outdoor, traditional filter-media dust collector that is installed compliant with NFPA 664 to include the use of explosion protection on the outdoor dust collector, deflagration propagation protection (isolation) on the outdoor dust collector, ignition source control in the form of a spark detection and extinguishment system upstream of the outdoor dust collector, and protection against the transmission of the hazardous byproducts of a fire event from the outdoor dust collector back into the facility.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
