OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards by motor vehicles when working in the roadway without high visibility safety vests and/or a warning system to alert drivers of employees working in the roadway: On or about April 19, 2019, employees engaged in tree trimming operations within the traveled way of a residential street were exposed to struck-by hazards from vehicular traffic when inserting branches into a wood chipper.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: On or about April 19, 2019, two employees were exposed to head injuries while working below tree trimming operations being performed directly above them and the employer did not ensure that each employee wear a protective helmet.
