29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:(a) On or about April 19, 2019, and at times prior to the employer had not developed and was not able to provide a copy of a written hazard communication program. Employees were exposed to hazardous chemicals including but not limited to Peroxyacetic acid.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (Agriculture Reference: 1928.21(a)(5)) On or about April 19, 2019, and at times prior thereto, employees were exposed to chemical hazards including, but not limited to eye damage and dermal contact with corrosive chemicals. Employees utilizing the chemicals were not familiar appropriate personal protective equipment to be used while mixing and applying the chemical.
