29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a) Performance Castings, LLC -  On or about April 22, 2019, and at times prior thereto: employees were required to wear 3M brand, N95, particulate respirators during furnace relining. The employer's written respiratory protection program did not include worksite specific procedures, in that the employer's written respiratory protection program did not include information including, but not limited to, the following:    1.) Mandatory use of respiratory protection (I. e. Type of respiratory protection required, when respiratory protection would be required.);    2.) Fit testing procedures for tight-fitting respirators (I.e. Who would perform them and how.);      3.) Medical evaluations of employees required to use respirators (I.e. Where they would be performed and when.);      4.) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;    5.) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators;    6.) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance (I.e. Who would be responsible for conducting training, how training would be conducted, when training would be conducted); and    7.) Procedures for regularly evaluating the effectiveness of the program.      Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) Performance Castings, LLC -  On or about April 22, 2019, and at times prior thereto: employees, required to wear 3M brand, N95, particulate respirators, during furnace relining, were not provided medical evaluations to determine if they were medically able to wear such respirators.       Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.134(f)(2): The employer did not ensure that all employees using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator, whenever a different facepiece (size, style, model or make) is used, and at least annually thereafter:    a) Performance Castings, LLC -  On or about April 22, 2019, and at times prior thereto: employees required to wear 3M brand, N95, particulate respirators during furnace relining had not been provided fit-testing prior to initial use of the respirator.      Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:    a) Performance Castings, LLC - On or about April 22, 2019, and times prior thereto: The employer did not determine employee exposures to silica, during furnace relining.        Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.1053(d)(3)(iii): Where the most recent exposure monitoring indicated that employee exposures were at or above the action level but at or below the PEL, the employer did not repeat such monitoring within six months of the most recent monitoring:  a) Performance Castings, LLC - The company discontinued sampling of a laborer when sampling results indicated employee exposure to silica above the action level.  Monitoring records provided by the company, on or about April 22,2019,  indicated a laborer was exposed to 34 ug/m3, as an 8 hour Time-Weighted Average (TWA), on June 20, 2018, during No Bake Molding operations. The company had not conducted additional monitoring.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.1053(f)(2)(i): The employer did not establish and implement a worksite specific written exposure control plan    which address the elements listed in 29 CFR 1910.1053(f)(2)(i)(A) through (f)(2)(i)(C):      a) Performance Castings, LLC - On or about April 22, 2019, the employer's written exposure control plan did not contain a description of all of the tasks in the workplace that involve exposure to respirable crystalline silica.     b) Performance Castings, LLC - On or about April 22, 2019, the employer's written exposure control plan did not contain a description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task    c) Performance Castings, LLC - On or about April 22, 2019, the employer's written exposure control plan did not contain a description of housekeeping measures used to limit employee exposure to respirable crystalline silica.        Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
