29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Performance Castings, LLC - On or about April 22, 2019, and at times prior thereto: employees were required to wear 3M brand, N95, particulate respirators during furnace relining. The employer's written respiratory protection program did not include worksite specific procedures, in that the employer's written respiratory protection program did not include information including, but not limited to, the following: 1.) Mandatory use of respiratory protection (I. e. Type of respiratory protection required, when respiratory protection would be required.); 2.) Fit testing procedures for tight-fitting respirators (I.e. Who would perform them and how.); 3.) Medical evaluations of employees required to use respirators (I.e. Where they would be performed and when.); 4.) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; 5.) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; 6.) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance (I.e. Who would be responsible for conducting training, how training would be conducted, when training would be conducted); and 7.) Procedures for regularly evaluating the effectiveness of the program. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
