On or about April 19, 2019, the employer had not developed a written respiratory protection program for employees who were directed to wear N-95 respirators when dry cutting concrete containing crystalline silica.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a.    On or about April 19, 2019, an employee operating a concrete cutting saw, was exposed to a head injury hazard in that he was not wearing a hard hat to protect from the hazard of flying concrete debris or a kick back hazard from the saw.

On or about April 19, 2019, an employee operating a concrete cutting saw was exposed to an eye injury hazard and a facial laceration hazard in that he was not wearing protective eyeglasses or a face shield to protect from flying concrete debris.
