29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. On April 18, 2019 located at the intersection of 8th and Main St Cincinnati OH employee(s) were wearing ANSI/ISEA 107-2015 Class II High Visibility reflectorized apparel vest and preforming nighttime urban area remote camera video sewer recording associated activities in a work zone roadway without physical barriers utilizing 42 inch high visibility grabber cone devices between a company vehicle, themselves and the struck by hazard of adjacent through traffic flow without the employer initiating and maintaining a program to determine the appropriate Class required by Performance Class III High Visibility reflectorized apparel in complex background work zone roadway work with Typical Factors or Characteristics for Workers Wearing Performance Class III such as but not limited to nighttime work, lack of physical barriers, work on roadway and urban areas.
