29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:     (a) Roof - The employer did not have a competent person on the job site in that none of the employees who worked on the site on April 17, 2019 inspected the job site, identified predictable fall hazards, and took immediate actions to correct the hazards.  As a result, employees did residential roofing work on a two-story single-family home without using fall protection and without extending the ladders used to access the roof three feet above the landing surface, exposing the employees the hazard of falling to a lower level.  In addition, each employees did not wear eye protection when using or working near other employees using pneumatic nailers to attach roofing materials, exposing employees to the hazard of getting struck-by ricocheting nails.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:    (a) Roof - Employees used pneumatic nailers to install new roofing materials, including new shingles, and the employer did not ensure that each employee wore eye protection, exposing the employees to a struck-by hazard from ricocheting nails, on or about April 17, 2019.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    (a) Roof - Employees did roofing work, including installing new shingles, on the two-story single-family home, which had an eave height of 11 feet 3 inches to the left of the chimney at the front of the house and an eave height of 18 feet 2 inches above the front door.  The employees did not use guardrail systems, safety net systems, or personal fall arrest systems for fall protection nor did they use an alternative fall protection measure.  Instead, employees wore full body harnesses but did not tie off, exposing the employees to the hazard of falling from the roof to the ground below, on or about April 17, 2019.    No abatement certification or documentation required.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) Roof - To gain access to the roof, employees used two portable extension ladders, positioned at the front of the house.  One ladder only extended two feet above the roof (upper landing) surface, and the other ladder only extended one foot above the roof (upper landing surface), exposing the employees to the hazard of falling 11 feet to the ground below, on or about April 17, 2019.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
