29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc:    West, machine shop, HAAS CNC lathe model no. SL-30 and HAAS CNC mill model no. VF-0E. - on or about April 24, 2019, safety devices installed to detect opening of the sliding access doors were overridden and could not ensure that the operating cycles would stop when the doors were opened.  Operators were exposed to struck-by and caught in-between hazards of moving machine components in the danger zone likely to result in serious injury when inserting/removing parts.    There is no abatement certification or documentation required for this item.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  Shipping and receiving dock, Yale, model no. GLC050DENUAE083 counterbalanced forklift - on or about April 24, 2019, the employer permitted use of a subject forklift equipped with forks that had holes for lifting and handling loads. Such modifications for use affected the vehicle's capacity and safe operation without the manufacturer's prior written approval or equivalent safety analysis performed by a qualified registered professional engineer.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:    On or about April 24, 2019, forklift operators' skills in safe operation of the vehicles used in the workplace were not evaluated at least once every three years. Provided refresher training on January 29, 2019, did not contain performance evaluation of the operating skills to ensure safety.     Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:        29 CFR 1910.1200(e)(1)(i) A list of the hazardous chemicals known to be present using a product identifier that is      referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for      individual work areas); and,            29 CFR 1910.1200(e)(1)(ii) The methods the employer will use to inform employees of the hazards of non-routine tasks (for      example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their       work areas.    On or about April 24, 2019, employees were exposed to hazards associated with use of Denatured Alcohol in the workplace because Hazard Communication Program was not established to ensure safe handling and use.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.    On or about April 24, 2019, employees were exposed to hazards associated with use of Denatured Alcohol in the workplace because training about its dangers and safe use and handling was not provided.     Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
