29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on April 23, 2019 on the jobsite located at 18206 Cedar Cir., Omaha, NE 68130. Five employees were working on the roof of an existing 2-story house. Three of them were not tied off or using any other form of fall protection. The height from the lowest edge to the ground is approximately 10.5 feet. Jose Rodriguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1395657, citation number 1, item number 2, and was affirmed as a final order on February 13, 2018 with respect to a workplace located at 9726 Nottingham Rd., Omaha, NE 68114.
