29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59):    At a jobsite located at the intersection of 3rd Street and Southwest Murray Road, Lees Summit, Missouri 64081, employees were exposed to serious health hazards from dermal, ingestion, and inhalation exposure to hazardous chemicals. The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.    At a jobsite located at the intersection of 3rd Street and Southwest Murray Road, Lees Summit, Missouri 64081, employees were exposed to serious struck-by and crushed-by hazards associated with trenching. Employees were working inside of an excavation where the accumulation of water was not adequately controlled.

A trench plate being used at the jobsite was not used and maintained in a manner that was consistent with the recommendations of the manufacturer. A 6x6 wood beam was being utilized to support trench plate. Also, proper trench plate overlap was not maintained in accordance to the recommendations of the manufacturer.
