29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  a) Rustic Rivers Home Owners at 230 North 53rd Avenue Place Greeley, CO 80634:  On and before April 19, 2019, the employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  Employees were involved with handling gasoline and caulking.  Employees were exposed to chemical and respiratory hazards.    Abatement note:  29 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Rustic Rivers Home Owners at 230 North 53rd Avenue Place Greeley, CO 80634: On and before April 19, 2019, the employer did not provide effective information and training on hazardous chemicals in their work areas.  Employees were handling chemicals such as caulk and gasoline.  Employees were exposed to chemical and respiratory hazards.   Abatement note:  29 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Rustic Rivers Home Owners at 230 North 53rd Avenue Place Greeley, CO 80634: On or before 04/19/19, the employer did not ensure that employees were protected from fall hazards while performing roofing work on a residential home. Five employees were performing re-roofing work on a roof pitch of approximately 8/12 without the use of fall protection. This condition exposed employees to fall hazards of approximately 20 feet.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  a) Rustic Rivers Home Owners at 230 North 53rd Avenue Place Greeley, CO 80634: On or before 04/19/19, the employer did not ensure that employees were properly using a portable ladder for access to the rooftop of a residential home. The employees were accessing the roof to perform roofing work, and the ladder did not extend at least 3 feet above the surface being accessed nor was the ladder secured to a rigid support. This condition exposed employees to fall hazards from approximately 20 feet.
