29 CFR 1926.753(c)(1)(iii): Where a deficiency was determined to constitute a hazard, the hoisting equipment was not be removed from service until the deficiency was corrected. On or about April 25, 2019, a crane being used for steel erection had a load hook that was missing a safety latch. This condition exposed employees to struck by hazards.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. On or about April 25, 2019 employees who were performing steel erection were not trained in fall protection hazards. This condition exposed employees to fall hazards greater than 15 feet from the ground.
