29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:    a) Salazar Roofing located at 2613 8th Ave. Garden City, CO 80631:  On and preceding April 25, 2019, The employer did not ensure that listed, labeled, or certified equipment was installed and used in accordance with instructions included in the listing, labeling, or certification.  Several flexible cords used to power battery charges and other power tools such as a grinder, were plugged in series (daisy chained).  At the time of the inspection there were three flexible cords in series with a multi-outlet cord at the end which supplied power to two battery charges.  The following condition exposed employees to electrical shock and fire hazards.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables used for temporary wiring were not protected from damage:  a) Salazar Roofing located at 2613 8th Ave. Garden City, CO 80631:  On and preceding April 25, 2019, the employer did not ensure that flexible cords and cables used for temporary wiring were protected from damage.  Several flexible cords used to power battery charges and other power tools such as a grinder, were damaged with the outer jacket torn. At the time of the inspection the flexible cords that were run outside of the window to the area of the metal decking had several cuts which exposed the inner insulation.  The following condition exposed employees to electrical shock and fire hazards.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    a) Salazar Roofing located at 2613 8th Ave. Garden City, CO 80631:  On and preceding April 25, 2019, the employer did not ensure that each employee engaged in the installation of metal decking on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level was protected from fall hazards.  Employees installing metal decking on a 2/12 pitch metal roof which ranged from 21-26 feet high were not protected by falls by the use of a personal fall arrest nor were any other means provided to protect employees from falls.  The employees were working near the edge using hand tools to secure metal decking to a new addition commercial building.  No fall protection was available in the area where they were working and a controlled access zone was not established.  The following condition exposed employees to falls from up to 26 feet.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Salazar Roofing located at 2613 8th Ave. Garden City, CO 80631:  On and preceding April 25, 2019, the employer did not develop, implement, and/or maintain at the workplace a written hazard communication program. Employees were utilizing sealant during metal decking installation.  The employer did not have a program which trained employees on the potential hazard associated with exposure to the specific chemicals that they were utilizing.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  a) Salazar Roofing located at 2613 8th Ave. Garden City, CO 80631:  On and preceding April 25, 2019, the employer did not maintain and provide, in the workplace, copies of the required safety data sheets for each hazardous chemical employees were exposed to. Employees installing metal decking on a commercial construction roof were utilizing sealant to fill gaps between vents and others portions of the roof.  SDS's were not available to inform each employee of the potential hazards of the chemicals that they are exposed to which primarily consists of the sealant.
