29 CFR 1926.20(b)(2): The employer did not ensure a safety program was in place to provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer:     (a)J&E Hernandez Construction at 7808 West Stoney Creek Street, Sioux Falls, SD 57106: On or about and at times prior to April 25, 2019, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Six subcontractor employees were working in close proximity to the edge of a roof on a one-story residential home, without the use of a fall protection system. The subcontractor employees were engaged in re-roofing activities. This condition exposed employees to a fall hazard of approximately 11 feet at the eave and 22 feet at the rake edge.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:     (a)J&E Hernandez Construction at 7808 West Stoney Creek Street, Sioux Falls, SD 57106: On or about and at times prior to April 25, 2019, the exposing employer did not ensure employees were protected from fall hazards by use of an appropriate fall protection system. Employees were engaged in re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed six employees to a fall hazard of approximately 11 feet at the eave and 22 feet at the rake edge.
