29 CFR 1910.28(b)(6)(i): Each employee less than 4 feet (1.2 m) above dangerous equipment was not protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. (a) RAA Colorado, LLC, dba Waste Management of Colorado, Inc., at 3600 E 48th Ave in Denver, Colorado 80216: On or before April 26, 2019, the employer did not ensure that employees were protected from injury, in that an in-floor conveyor in the south side of the Material Recovery Facility was not guarded to prevent an employee from stepping into or falling onto the conveyor. The conveyor was below the floor surface at least two feet, was approximately three feet wide and ran half the length of the building. This condition exposed employees to struck-by hazards when contacting the rotating parts.

29 CFR 1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, were not protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires. (a) RAA Colorado, LLC, dba Waste Management of Colorado, Inc., at 3600 E 48th Ave in Denver, Colorado 80216: On or before April 26, 2019, the employer did not ensure that employees were protected from injury, in that a shaft on the west side of the middle sorting conveyor of the Material Recovery Facility was missing side castings that would prevent an employee standing to either side from becoming entrapped. This condition exposed employees to the hazard of rotating parts.
