29 CFR 1910.1200(e)(1) as referenced by 29 CFR 1926.59:  Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     a) Worksite, 131 Bergen St., Newark, NJ    The employer failed to implement a written hazard communication program for employees installing EFIS siding insulation using chemicals including but not limited to Sto Medium Sand Finish, a water based acrylic coating,  Sto Gold Coat, a water based latex coating, and Sto Primer Adhesive B which contains crystalline silica.       Violation occurred on or about 4-17-19

The employer did not maintain safety data sheets on site for these chemicals.     Violation occurred on or about 4-17-19

29 CFR 1926.451(g)(4)(ix): Midrails, screens, mesh, intermediate vertical members, solid panels, and equivalent structural members of a guardrail system were not capable of withstanding, without failure, a force applied in any downward or horizontal direction at any point along the midrail or other member of at least 75 pounds (333 n) for guardrail systems with a minimum 100 pound toprail capacity, and at least 150 pounds (666 n) for guardrail systems with a minimum 200 pound toprail capacity:    Worksite, 131 Bergen St., Newark, NJ    Employees installing exterior EFIS from a pump jack scaffold were exposed to fall hazards of approximately 16 feet to the ground below in that the fall arrest screen used on the scaffold was secured to the ladder work rest/guardrail with cloth ties instead of using the manufacturer's pick for the work rest that was provided with the correct grommets to secure the fall arrest screen.       Violation occurred on or about 4-17-19

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:  Worksite, 131 Bergen St., Newark, NJ  Employees installing exterior EFIS from a pump jack scaffold were exposed to fall hazards of approximately 16 feet to the ground below in that each lifeline associated with their personal fall arrest system was connected to the roof by securing each lifeline snap hook to one nail.   Violation occurred on or about 4-17-19
