29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Enclave Development, LLC at Silverthorne Flats, South Silverthorne Avenue, Sioux Falls, SD 57110: On or about and at times prior to May 1, 2019, the controlling employer did not initiate and maintain programs to provide for frequent and regular inspections of the jobsite conducted by a competent person. Framing and gutter subcontractors were working over six feet while exposed to fall hazards without the use of a fall protection system. Framing subcontractors were also working off scaffolding or temporary work platforms that were not equipped with fall protection. This condition exposed subcontractor employees to fall hazards between 13 and 33 feet when performing work on a three-story apartment building.
