29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Peak One Construction LLC at 1150 Inca St., Denver CO: On and before May 2, 2019, the exposing employer did not ensure that three employees were protected from injury, in that employees were conducting roofing work on a second story roof and wore harnesses but the harnesses were not attached to the lanyards of the fall protection systems, when working around unguarded ridges and eaves of the roof and an unguarded skylight on the roof. This condition exposed the employees to fall hazards up to approximately 28 feet.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head: (a) Peak One Construction LLC at 1150 Inca St., Denver CO: On and before May 2, 2019, the exposing employer did not ensure that employees were protected from injury, in that one employee, conducting roofing work on a second story roof, was wearing a fall harness but the lanyard was attached to the front of the fall harness at chest level. This condition exposed the employee to bodily injury. Abatement Note: As of January 1, 1998, Subpart M of the 29 CFR 1926 part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). Abatement Note: 1926.502(d)(17) states the attachment point of the body harness shall be located in the center of the wearers back near shoulder level, or above the wearer's head.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Peak One Construction LLC at 1150 Inca St., Denver CO: On and before May 2, 2019, the exposing employer did not ensure that each employee, engaging in or supervising roofing work on a second story roof of a residential home, were trained to recognized the hazards of falls and the use of fall protection systems. Three employees wore harnesses but the harnesses were not attached to the lanyards of the fall protection system, when working around unguarded ridges and eaves of the roof and an unguarded skylight on the roof. This condition exposed the employees to fall hazards up to approximately 28 feet. (b) Peak One Construction LLC at 1150 Inca St., Denver CO: On and before May 2, 2019, the exposing employer did not ensure that each employee, engaging in or supervising roofing work on a second story roof of a residential home, were trained to recognized the hazards of falls and the use of fall protection systems. An employee, conducting roofing work on the second story roof was wearing a fall harness but the lanyard was attached to the front of the fall harness at chest level. This condition exposed the employee to bodily injury. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4) The role of each employee in the safety monitoring system when this system is used; 5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 7) The role of employees in fall protection plans; 8) The standards contained in this subpart.
