29 CFR 1926.300(b)(1): Power operated tools that were designed to accommodate guards were not equipped with the guards when they were in use, to protect the operator and employees nearby from hazards such as ingoing nip point, rotating parts, flying chips, or sparks: a) The Bosch grinder did not have a blade guard, being used with an 8 inch notched blade; employee was exposed to laceration hazard when using the grinder to cut bricks. Location: 2341 E 15th Street, Brooklyn NY On or about 4/24/2019 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with: (i) At least one handrail; and (ii) One stairrail system along each unprotected side or edge. a) There was no stairrails on the stairways to 2fl and 3fl; employees were exposed to trip/ fall hazard when using the stairs during construction activities.
