29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about May 1, 2019, and at times prior thereto, employees were exposed to a caught in hazard while installing sewer line piping in a benched trench that the competent person determined was type c soil.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. On or about May 1, 2019, and at times prior thereto, employees were exposed to a caught-in hazard while performing pipe work in a trench that did not meet the conditions and requirements in Appendix B-1.3 for excavations in Type C soil.
