29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) First Avenue West North Water Main Replacement Project, Kalispell, MT: On or about April 30, 2019 and at times prior employees were exposed to cave in hazards while installing a new 8 inch water main line in a 5 foot 3 inch vertical wall trench while performing work without a protective system in place.
