29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite: On or about May 2, 2019, three employees were replacing the roof and none of them were properly tied off. One employee was using a body belt to tie off with and two employees were using rock climbing harnesses. None of the employees were using a body harness for fall protection. The fall hazard to the employee was about 25 feet to the ground.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) Jobsite: On or about May 2, 2019, the employer needs to retrain the employees who are exposed to fall hazards on how to recognize fall hazards and how and when to use the proper fall protection equipment.
